- (a) Arkansas law requires that orders for payment of money for the support and care of any children include a provision for the withholding of the full amount of past due support owed by the noncustodial parent not to exceed fifty percent (50%) of the net lump-sum payment (entire amount of lump sum less any amount required by law to be withheld) paid to the noncustodial parent.
(b) Lump-sum payments are defined as:
- (1) A form of income paid to an individual at other than regular or periodic intervals;
- (2) Payment regardless of frequency that is dependent upon meeting a condition precedent, including the performance of a contract;
- (3) A job performance standard or quota;
- (4) The liquidation of unused sick or vacation pay or leave;
- (5) The settlement of a claim; or
- (6) An award for length of service.
