(a) The Office of Child Support Enforcement may receive a Medicaid referral for cases in which a child under eighteen (18) has been placed in a treatment facility if:
(1) There was a noncustodial parent absent from the home at the time of placement; and
(2) An office case is open against that absent parent, but not against both parents.
(b) If both parents are in the home at the time of placement and the placement was not due to abuse or neglect on the part of the parents, the office is not required to provide services.
(c) The Department of Health makes the determination and refers cases as appropriate.
