8 CAR § 350-201 – Applicability

(a) This subpart shall apply to:
1. (1) All landfills and transfer stations proposed to be located either wholly or partially within the jurisdiction of the White River Regional Solid Waste Management District; or
2. (2) The expansion of any existing landfill within the jurisdiction of the district.
(b) A certificate of need is not required for landfills where a private industry bears the expense of operating and maintaining the landfill solely for the disposal of wastes generated by the industry or wastes of a similar kind or character.
