(a)
- (1) Upon receipt of a certificate of need, the applicant has sixty (60) days in which to file a preapplication for a solid waste facility permit with the Division of Environmental Quality or the certificate of need shall become void.
- (2) Upon receipt of a certificate of need, the applicant has six (6) months in which to file a permit application for a solid waste permit facility with the division or the certificate of need shall become void.
- (b) Certificates of need are issued to a specific person or persons and are not transferrable under any circumstances.
