(a) The Southwest Arkansas Regional Solid Waste Management District Board will administer the certificate of need review program which:
- (1) Applies to the offering of new or increased solid waste landfill disposal capacity within its jurisdictional boundaries; and
- (2) Is consistent with the laws of the state.
- (b) In performing its review functions, the board shall follow procedures and apply criteria developed in accordance with procedures and this part.
