For the purposes of this part, the following definitions shall apply:

1. (1) “APA” means the Arkansas Administrative Procedure Act, Arkansas Code § 25-15-201 et seq., as amended from time to time;
2. (2) “ADEQ” or “division” means the Division of Environmental Quality;
3. (3) “Board” means the Board of Directors of the Southeast Arkansas Regional Solid Waste Management District;
4. (4) “Board members” means the members of the Board of Directors of the Southeast Arkansas Regional Solid Waste Management District;
5. (5) “Commission” means the Arkansas Pollution Control and Ecology Commission;
6. (6) “Director” means the duly appointed chief administrative officer of the Southeast Arkansas Regional Solid Waste Management District, regardless of the actual position title;

7. (7) “District” means the Southeast Arkansas Regional Solid Waste Management District, which includes the counties of:

   1. (A) Arkansas;
   2. (B) Ashley;
   3. (C) Bradley;
   4. (D) Chicot;
   5. (E) Cleveland;
   6. (F) Desha;
   7. (G) Drew;
   8. (H) Grant;
   9. (I) Jefferson; and
   10. (J) Lincoln;

8. (8) “Person” means any:

   1. (A) Individual;
   2. (B) Partnership;
   3. (C) Corporation;
   4. (D) Association; or
   5. (E) Public or private organization of any character;
9. (9) “Rule” means any Southeast Arkansas Regional Solid Waste Management District rule or statement of general applicability and future effect that implements, interprets, or prescribes law or mandatory policy, or describes the organization, procedure, or practice of the Southeast Arkansas Regional Solid Waste Management District; and
10. (10) “Rulemaking action” shall include any action by the Southeast Arkansas Regional Solid Waste Management District to adopt, amend, or repeal any Southeast Arkansas Regional Solid Waste Management District rule.
