(b) Each step in the process must be completed prior to a certificate of need being issued or denied:

1. (1)

   1. (A) Letter of intent.
   2. (B) A letter of intent is required for every proposal to be reviewed.
   3. (C) A potential applicant must submit a letter of intent to the Board of Directors of the Sebastian County Regional Solid Waste Management District prior to submission of an application.
   4. (D) See 8 CAR § 270-206;

2. (2)

   1. (A) Submission of application.
   2. (B) The applicant is responsible for submitting all information concerning the proposed acquisition of a certificate of need for the purpose of obtaining a solid waste landfill and/or transfer station permit.
   3. (C) See 8 CAR § 270-208;

3. (3)

   1. (A) Determination of completeness.
   2. (B) The board will:

(i) Determine the completeness of an application; and

(b) (b) If no requests for additional information are made by the board within two (2) weeks, the application will be deemed to be complete and affected persons will be notified of the beginning of the review.

2. (4)

   1. (A) Beginning of review.
   2. (B) The initiation of the sixty-day review period begins on the date of notification by the board, by certified letter, to the applicant of the completeness of the application and the beginning of the review, or, on the date that the public notice appears in the newspaper, whichever is later.
   3. (C) See 8 CAR § 270-208(a);

3. (5)

   1. (A) Notification of the beginning of review.
   2. (B) Upon determination of completeness, the board will notify, in writing, the applicant and all other affected persons that the review period for the application has begun.
   3. (C) See 8 CAR § 270-205(b)(1) and (2);

4. (6)

   1. (A) Public hearing during the course of review.
   2. (B) The board will provide a public hearing during the course of review.
   3. (C) See 8 CAR § 270-208(f); and

5. (7)

   1. (A) Board findings.

   2. (B) The board will:

      1. (i) Make a final determination on the application based on the established criteria; and
      2. (ii)

1. (C)

   1. (i) This determination will be made within sixty (60) days from the beginning of review.

      1. (ii) See subdivision (b)(4) of this section.

   2. (D) Such findings will be sent to:

      1. (i) The applicant;
      2. (ii) The Division of Environmental Quality; and
      3. (iii) Others upon written request.
