(a)

1. (1) The amount of the fee assessed shall be two dollars ($2.00) per ton.

2. (2)

   1. (A) Fifty cents (50¢) per ton of this fee shall be deposited into a fund designated for landfill diversion strategies and programs.
   2. (B) This fund is only to be used with approval by the Board of Directors of the Boston Mountain Regional Solid Waste Management District.

(b) If weight tickets are not available, the fee shall be calculated on a volume basis as follows:

1. (1) Twenty-five cents (25¢) per uncompacted cubic yard; and
2. (2) Forty-five cents (45¢) per compacted cubic yard.

(c)

1. (1) If solid wastes subject to a fee under this subpart and Subparts 16 and 17 of this part are shipped, delivered, or transported to another solid waste management district within this state that also imposes a fee pursuant to Arkansas Code § 8-6-714(a)(1)(A), then the fees imposed shall be divided between the districts pursuant to any interlocal agreement in place between the districts.
2. (2) If no interlocal agreement is in place, the larger of the fees shall be imposed and said fees shall be split evenly between the districts.
