(a) Any solid waste hauler license may be suspended or revoked by the Benton County Regional Solid Waste Management District if the hauler is in violation of:

1. (1) Federal, state, local, or district laws or rules related to the collection, transportation, or disposal of solid waste; or
2. (2) Any other law related to health, safety, or the environment.

(b) The district may revoke or suspend a hauler’s license under the following conditions:

1. (1) The district may suspend a hauler’s license for six (6) months if they are assessed penalties totaling five (5) points within a twelve-month period;
2. (2) The district may suspend a hauler’s license for twelve (12) months if they are assessed penalties totaling ten (10) points within a twelve-month period;
3. (3) The district may permanently revoke a hauler’s license if they are assessed penalties totaling fifteen (15) points within a twelve-month period; and
4. (4) The district may permanently revoke a hauler’s license if they are suspended for more than twelve (12) months in any thirty-six month period.
