(a) A license shall be issued only to:

1. (1) A person;
2. (2) A partnership;
3. (3) A corporation;
4. (4) An association;
5. (5) The State of Arkansas;
6. (6) A political subdivision of the state;
7. (7) An improvement district;
8. (8) A sanitation authority; or
9. (9) Another regional solid waste management district.

(c) In order to be eligible for issuance of a solid waste hauler’s license by the Board of Directors of the Benton County Regional Solid Waste Management District, a solid waste hauler must:

1. (1) Hold the appropriate driver’s license as defined by Arkansas law;

2. (2) Annually register its operation with the board providing:

   1. (A) Name, address, and telephone number of registrant;
   2. (B) Description of vehicle or vehicles to be registered including:

(i) Make, model, and year of vehicle;

1. (ii) Vehicle identification number;

   1. (iii) License plate number; and

      1. (iv) Name of vehicle owner;
   2. (C) Description of the nature of wastes and size of loads; and
   3. (D) The location of disposal of waste;
2. (3) Establish and maintain financial responsibility acceptable to the board;
3. (4) Disclose all violations of federal, state, local, or district laws or rules regarding the collection, transportation, or disposal of solid waste within the preceding twelve (12) months; and
4. (5) Provide proof of correction of any violations of federal, state, local, or district laws regarding the collection, transportation, or disposal of solid waste.
