(a) The following persons shall have the right to appeal any grant decisions made by the Board of Directors of the Benton County Regional Solid Waste Management District:

1. (1) A grant applicant;
2. (2) A grantee;
3. (3) Any person who submitted written comments on the contested matter within the comment period;
4. (4) A board member; or
5. (5) Any other person entitled by law to contest the board’s decision.

(b)

1. (1) The request for appeal must be in writing and received by the Benton County Regional Solid Waste Management District office no later than close of business ten (10) days after the date of approval of grant projects by the board.
2. (2) If the tenth day falls on a Saturday, Sunday, or state holiday, the request is due by close of business the following business day.

(c) Requests for appeal may be delivered to the district:

1. (1) In person; or
2. (2) By certified mail, return receipt requested.
