8 CAR § 190-202 – Applicability

(a)
1. (1) This subpart shall apply to:
  1. (A) Every solid waste facility proposed to be located either wholly or partially within the jurisdiction of the Faulkner County Regional Solid Waste Management District; or
  2. (B) The expansion of any existing landfill within the jurisdiction of the district.
2. (2) This subpart shall apply to facilities that do not have a preapplication pending with the Division of Environmental Quality for a new permit or modification of an existing permit as of the effective date of this part.
(b) A certificate of need is not required for landfills where a private industry bears the expense of operating and maintaining the landfill solely for the disposal of wastes generated by the industry or wastes of similar kind or character.
