(a) Employers shall develop, implement, and maintain at the workplace, a written hazard communication program for their workplaces which at least describes how the criteria specified in 8 CAR §§ 100-106 – 100-108 for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which shall include the following:

1. (1)

   1. (A) A list of the hazardous chemicals known to be present, regardless of quantity, using an identity that is referenced on the appropriate material safety data sheet.
   2. (B) The list may be compiled for the workplace as a whole or for individual work areas; and

2. (2) The methods the employer will use to inform employees of the hazards:

   1. (A) Of nonroutine tasks; and
   2. (B) Associated with chemicals contained in unlabeled pipes in their work areas.

(b) Multi-employer workplaces. Employers who produce, use, or store hazardous chemicals at a workplace in such a way that the employees of other employers may be exposed, for example, employees of the Building Authority Division working on site at another state agency, shall ensure that they have a hazard communication program developed and implemented which includes the following:

1. (1) The methods the employer will use to provide other employers with a copy of the material safety data sheet, or to make it available at a central location in the workplace, for each hazardous chemical other employers’ employees may be exposed to while working;

2. (2) The methods the employer will use to inform other employers of any precautionary measures that need to be taken to protect employees:

   1. (A) During the workplace's normal operating conditions; and
   2. (B) In foreseeable emergencies; and
3. (3) The methods the employer will use to inform other employers of the labeling system used in the workplace.
