(a) No information shall be protected as confidential unless:
- (1) It is submitted in accordance with this subpart; and
- (2) The Director of the Division of Environmental Quality finds the information would constitute a trade secret under Arkansas law.
- (b) If the director determines information that is properly submitted constitutes a trade secret, then the information shall be kept confidential in accordance with 8 CAR § 80-805.
