The following definitions, in addition to the definitions in Subpart 1 of this part, apply to this subpart:

   1. (A)

      1. (i) “Operator” means any person in control of, or having responsibility for, the daily operation of the underground storage tank system.
      2. (ii) This term shall not include contractors or consultants performing compliance monitoring, testing, emergency response, or other services on an underground storage tank system for a tank owner or operator.
   2. (B) “Class A operator” means any operator having primary responsibility for on-site operation and maintenance of underground storage tank systems.
   3. (C) “Class B operator” means any operator having daily on-site responsibility for the operation and maintenance of underground storage tank systems.
   4. (D) “Class C operator” means a daily, on-site employee having primary responsibility for addressing emergencies presented by a spill or release from an underground storage tank system; and
2. (2) “Unmanned facility” means any facility that does not have an operator on site during operation of the underground storage tank system.
