The following definitions, in addition to the definitions in Subpart 1 of this part, apply to this subpart:

(A)
- (i) “Operator” means any person in control of, or having responsibility for, the daily operation of the underground storage tank system.
- (ii) This term shall not include contractors or consultants performing compliance monitoring, testing, emergency response, or other services on an underground storage tank system for a tank owner or operator.
- (B) “Class A operator” means any operator having primary responsibility for on-site operation and maintenance of underground storage tank systems.
- (C) “Class B operator” means any operator having daily on-site responsibility for the operation and maintenance of underground storage tank systems.
- (D) “Class C operator” means a daily, on-site employee having primary responsibility for addressing emergencies presented by a spill or release from an underground storage tank system; and
- (2) “Unmanned facility” means any facility that does not have an operator on site during operation of the underground storage tank system.
