- (a) This subpart applies to all persons who perform testing on underground storage tank systems in Arkansas, including officers or employees of owners or operators, except as provided in subsections (b) and (c) of this section.
(b) This subpart does not apply to the testing of the following underground storage tanks:
- (1) Wastewater treatment tanks;
- (2) Sumps;
- (3) Underground storage tanks containing radioactive waste;
- (4) Electrical equipment tanks;
- (5) Hydraulic lift tanks; and
- (6) Any underground storage tank with a capacity of one hundred ten gallons (110 gals.) or less.
- (c) This subpart does not apply to the testing of any underground storage tank system holding hazardous wastes listed or identified under the Resource Conservation and Recovery Act of 1976, 42 U.S.C. § 6901 et seq., as amended, or the Arkansas Hazardous Waste Management Act of 1979, Arkansas Code § 8-7-201 et seq., as amended.
