The following definitions, in addition to the definitions in Subpart 1 of this part, apply to this subpart:

1. (1) “Company” means any person who contracts to test an underground storage tank system for a third party;
2. (2) “Test” or “testing” means the work involved in assessing the integrity of an underground storage tank system, including associated piping, to determine whether or not it is capable of meeting the tightness testing performance standards of 40 C.F.R. §§ 280.43(c) and 280.44(b); and
3. (3) “Tester” means an individual or company who tests underground storage tank systems in Arkansas.
