(a)

1. (1) The Division of Environmental Quality may undertake investigations it deems necessary to ensure compliance with this subpart.

2. (2)

   1. (A) The division may take actions it deems necessary to ensure compliance with this subpart, including:

(i) Issuing compliance orders;

1. (ii) Assessing penalties; and

   1. (iii) Revoking or suspending licenses.
   2. (B) The division may, to effectuate the actions described in subdivision (a)(2)(A) of this section, commence civil or administrative actions under Arkansas law or Subpart 9 of this part.

(b) The division may suspend or revoke the license for an individual or contractor upon grounds that the individual or contractor:

1. (1) Exercised fraud, misrepresentation, or deception in obtaining a license;

2. (2) Exhibited gross incompetence in the performance of:

   1. (A) An installation;
   2. (B) A repair;
   3. (C) An upgrade; or
   4. (D) A closure;
3. (3) Was derelict in the performance of a duty as a licensed individual or contractor; or
4. (4) Knowingly violated any provision of this part.
