(a)

1. (1) All claims for reimbursement submitted under this subpart are subject to the availability of moneys in the Petroleum Storage Tank Trust Fund.
2. (2) Nothing in this part shall be construed to create a permanent entitlement to moneys in the trust fund.
3. (3) The Arkansas Pollution Control and Ecology Commission reserves the right to amend this subpart, including the provisions regarding coverage and eligibility, and reasonable, allowable, and necessary costs.

(b)

1. (1) If the moneys in the trust fund prove insufficient to cover all trust fund claims for reimbursement, the Advisory Committee on Petroleum Storage Tanks shall recommend to the Director of the Division of Environmental Quality a priority system based upon whatever factors it deems appropriate.
2. (2) The director may adopt a priority system for reimbursement based upon any factors he or she deems appropriate.
