(a) If a used tire program fails to submit a new business plan for approval by the Division of Environmental Quality on or before September 1, 2023, the used tire program is:

1. (1) Ineligible to receive funding from the Used Tire Recycling Fund;
2. (2) Prohibited from administering and operating a used tire program; and
3. (3) Prohibited from imposing any fees to support the administration and operation of a used tire program.

(b)

1. (1) If a used tire program’s proposed business plan is determined to be administratively incomplete, the used tire program shall submit the additional information required by the division within ten (10) calendar days of written notice.
2. (2) If a used tire program fails to submit the additional information required by the division within ten (10) calendar days, the used tire program shall be deemed to have failed to submit a business plan.
