8 CAR § 64-1005 – Disbursements contingent upon available funding

(a) All reimbursements and distributions claimed by used tire programs will be:
1. (1) Based on moneys available for disbursement in that quarter;
2. (2) According to funding levels in 8 CAR § 64-1006;
3. (3) According to the rates established by the approved business plan; and
4. (4) Funding priorities in 8 CAR § 64-1007.
(b) Nothing in this part shall be construed as requiring the State of Arkansas or the Division of Environmental Quality to accrue liabilities in excess of available funding.
