(a) Late payment charges.

1. (1) A late payment charge of ten percent (10%) of the quarterly fee amount will be added to the net amount due if full payment is not received by the Division of Environmental Quality within fifteen (15) calendar days after the due date.
2. (2) An additional five percent (5%) of that quarterly fee amount will be added to the net amount for each additional month or fraction thereof during which such failure continues past the first fifteen (15) calendar days, not to exceed a total of twenty-five percent (25%).

(b) Late payment charge notification.

1. (1) If the division determines that any landfill permittee or transporter has not made a timely payment of the fee, a notification will be sent.
2. (2) Failure of the division to send such notice shall not operate as a waiver of a late payment charge.
