(a) Acceptable waste.
- (1) Only household waste, commercial, and industrial waste shall be accepted at the facility except that no industrial process waste or infectious waste shall be accepted unless specifically approved by the Division of Environmental Quality.
- (2) If Class 4 wastes are to be accepted for disposal at a Class 4 landfill, adequate provision shall be made for the proper separation, handling, storage, and transfer of this waste.
- (b) Ultimate disposal of waste. All solid waste passing through the transfer station must be ultimately reclaimed or recovered or disposed of at a permitted landfill.
- (c) Asbestos waste. Division approval is necessary prior to the acceptance of asbestos waste at a transfer station facility.
(d) Processing areas.
- (1) All processing, tipping, sorting, storage, compaction, and related activities must be conducted in an enclosed or covered area or, if outdoor areas are provided for these functions, within curbed areas where drainage is routed to an approved collection and treatment system.
- (2) Stormwater or wastewater discharges from the site shall conform to division permitting requirements.
- (e) Storage area. Adequate storage space for incoming solid waste must be available at the transfer station.
(f) External storage.
- (1) External storage of solid waste containing putrescible material is prohibited.
- (2) Nonputrescible solid waste which the facility has recovered for recycling may be stored out-of-doors at the facility for a period not to exceed one (1) week unless the material is properly containerized so that there is no opportunity for rainfall to come into contact with the waste unless the facility has a stormwater permit that includes the storage area.
- (3) No person shall store solid waste at the facility in such a manner that the storage area or solid waste becomes a nuisance, litter, sanitary, or environmental problem.
(g) Recoverable solid waste.
- (1) Recovery of solid waste must have prior approval by the division and be supervised by the operator.
- (2) Solid waste capable of recovery must be stored in clearly identified containers or areas, and maintained in a safe, sanitary, and orderly manner.
- (3) A record of the type and quantity of solid waste recovered must be maintained.
(h) Supervision of facility.
- (1) The transfer station shall have a licensed on-site operator who has been certified in accordance with Licensing of Operators of Solid Waste Management Facilities and Training and Certification Requirements for Environmental Officers, 8 CAR pt. 62, of the Arkansas Pollution Control and Ecology Commission on duty at all times the facility is open.
- (2) Suitable fencing, gates, or signs must be provided to limit unauthorized persons from access to the facility when the station is closed.
- (i) Signs. A sign must be posted with the hours of operation and the types of solid waste accepted and not accepted at the transfer station at all access points to the facility.
(j) Control of litter, insects, odors, and vectors.
(1) The operation of the transfer station and the storage and handling of all solid waste shall be practiced so as to prevent the attraction, harborage, or breeding of insects, rodents, and other vectors and to eliminate conditions which cause or may potentially cause:
- (A) Harm to the public health and the environment;
- (B) Safety hazards to individuals and surrounding property; and
- (C) Excessive odor problems, unsightliness, and other nuisances.
(2) In addition, the transfer station shall be maintained in a neat and orderly appearance at all times through:
- (A) The control of blowing litter;
- (B) Proper storage of solid waste and recyclables; and
- (C) Other measures as may be necessary.
(k) Facility maintenance.
- (1) Sanitary conditions shall be maintained through the periodic wash down or other appropriate cleaning method of the transfer station and transfer vehicles.
- (2) Frequency of cleaning shall be sufficient to prevent odors and other nuisance conditions from developing.
- (3) All residuals shall be properly disposed of following cleaning operations.
(l) Drainage.
- (1) All floors must be free from standing water.
- (2) All drainage from cleaning, unloading, and processing areas must be discharged to sanitary sewers or permitted on-site treatment facilities.
- (3) Stormwater discharges from the site shall conform to division stormwater permitting requirements.
- (m) Fire protection. Adequate fire protection equipment must be available at all times.
(n) Annual reporting.
- (1) The facility owner or operator shall prepare and file with the division annual reports by March 31 covering the period from the previous January through December on a form provided by or acceptable to the division.
(2) Contents of the reports shall at a minimum include the:
- (A) Source, volume, or weight, and class of solid waste received at the facility;
- (B) Volume or weight and type of recyclables recovered, if any; and
- (C) Volume or weight of solid waste removed from the facility and the disposal location.
- (o) Employee facilities. Suitable enclosed office/pay station and restroom facilities shall be provided for employees.
(p) Operating plan.
- (1) All activities at the facility shall be performed in accordance with the permit plans and specifications and narrative required by this subpart and approved by the division.
- (2) All permit plans and specifications and narratives shall be maintained and be available for reference and inspection at the facility and shall be updated and reapproved by the division as necessary to reflect present operations.
(3) All facilities shall maintain an operating plan or narrative that describes:
- (A) How the requirements of this section will be satisfied;
- (B) The schedule of operation including the days and hours that the facility will be open;
- (C) Personnel required and their training and responsibilities;
- (D) Recordkeeping procedures and requirements;
- (E) A description of measures that will be taken to identify and control undesirable wastes received that could either contaminate other wastes or pose unusual health hazards and risks to employees such as infectious medical waste and hazardous wastes;
- (F) Equipment provided at the facility and its operation;
- (G) Site access control method;
- (H) A description of potential safety hazards and the safety equipment and protective gear, including but not limited to showers, eye wash, fire extinguisher, hoses, hard hats, safety goggles, respirators, hearing protection, and personal hygiene facilities as appropriate;
- (I) Firefighting procedures, including availability of water for firefighting;
- (J) A contingency plan outlining the corrective or remedial measures that will be taken if unapproved wastes are delivered to the facility and in the event of odors, surface or ground water contamination, spills, equipment breakdown, and other undesirable conditions such as fires, dust, noise, and vectors;
- (K) Closure plan; and
- (L) Other information as required by the division that is appropriate to the facility operating plan.
