(a) Applicability.

1. (1) Composting facilities shall be classified by the type of materials received and treated.

2. (2)

   1. (A) Facilities that receive and treat only wastes identified in 8 CAR § 60-801(b)(3)(A) shall be classified as Type Y compost facilities.
   2. (B) Operations of Type Y facilities shall be covered under a general permit.
3. (3) Facilities that receive and treat only source separated organic wastes, such as paper, food wastes, food processing wastes, other compostable materials, or yard waste in combination with these wastes shall be classified as Type O compost facilities.
4. (4) Facilities that receive and treat mixed solid wastes such as household garbage, nonhazardous commercial wastes, or yard waste or source separated organic wastes in combination with these wastes shall be classified as Type S compost facilities.

   1. (A) Facilities that receive and treat municipal sewage sludge in combination with wastes in subdivisions (a)(2) and (3) of this section above shall be classified as Type O compost facilities.
   2. (B) Facilities that receive and treat sewage sludge with wastes in subdivision (a)(3) of this section, above, shall be classified as Type S facilities.
