Disposal of spent pesticide and herbicide containers

- (a) Applicability. No person shall dispose of any pesticide or herbicide containers, or any residue therefrom in a manner inconsistent with its labeling or intended use, or in violation of 40 C.F.R. § 261.7(b)(3) or state pollution control or plant board standard.
(b) Triple rinsing.
- (1) Containers must first be triple-rinsed with at least fifteen percent (15%) of the volume of the container, using rinse water as makeup whenever possible.
- (2) Salvageable containers may then be returned to the manufacturer or formulator, or a drum reconditioner for reuse.
- (3) Nonsalvageable, triple-rinsed containers may then be crushed and transported to a Class 1 landfill for disposal.
(c) Container residue.
(A) Container residue and rinse water should be added to application mixes in the field whenever possible.
- (B) If not, they must be disposed of in accordance with manufacturers' label instructions.
