- (a) Applicability. Owners or operators of all permitted facilities must ensure that the units do not violate any applicable requirements developed under a State Implementation Plan (SIP) approved or promulgated by the Administrator of the United States Environmental Protection Agency pursuant to Section 110 of the Clean Air Act, as amended.
- (b) Burning prohibition. Open burning of solid waste, except for the infrequent burning of agricultural wastes, silvicultural wastes, land-clearing debris, diseased trees, or debris from emergency cleanup operations and ordnance that may be allowed by the Arkansas Air Pollution Control Code, 8 CAR pt. 40, is prohibited at all units.
(c) Fire safety.
- (1) A facility or practice shall not pose a hazard to the safety of persons or property from fires.
- (2) This may be accomplished through compliance with this section and through the periodic application of cover material or other techniques as appropriate.
