(a) Applicability. Unless provided otherwise, the requirements of this section as well as 8 CAR §§ 60-525 and 60-528 – 60-532 shall apply only to:
- (1) Newly permitted facilities;
- (2) Increases in the permitted capacity or disposal area; or
- (3) Permit renewals as specified in 8 CAR § 60-309.
(b) Consideration of waste characteristics.
- (1) Landfills shall be subject to design and operational requirements dependent on the volume and physical, chemical, and biological nature of the wastes.
- (2) Design requirements shall also be dependent upon the geotechnical and hydrogeological characteristics of the site and surrounding locale.
- (3) The design proposed by the applicant in conformance with the criteria set forth herein shall be supported by complete hydrogeological and waste characterization data.
(c) Ground water monitoring required.
- (1) In accordance with 8 CAR § 60-523, a facility or practice shall be designed to prevent the contamination of an underground drinking water beyond the solid waste boundary or beyond an alternative boundary specified in accordance with 8 CAR § 60-523(b).
- (2) Except as provided in subdivision (f)(3) of this section and 8 CAR § 60-621(e), ground water monitoring shall be required to confirm that ground water standards contained in Appendix 3 or as otherwise established under Subpart 12 of this part are achieved.
- (d) Site characteristics. The site and waste characterization requirements of Subpart 11 of this part shall be met for all new units and expansions of the permitted disposal area.
- (e) Liner design criteria for Class 3 commercial landfills. New Class 3 commercial landfills and expansions to the area permitted for waste disposal shall meet the design requirements set forth in 8 CAR §§ 60-424 – 60-432.
(f) Liner design criteria for Class 3 noncommercial landfills. At a minimum, new Class 3 noncommercial landfills and expansions of the permitted fill area shall be constructed:
- (1) With a compacted clay liner of at least a two-foot thickness with a hydraulic conductivity of no more than 1 x 10-7 cm/sec and a leachate collection system that is designed and constructed to maintain less than a thirty-cm depth of leachate over the liner; or
(2)
- (A) In accordance with a design approved by the Director of the Division of Environmental Quality.
- (B) The design must ensure that the concentration values specified in Appendix 3 will not be exceeded in the uppermost aquifer at the relevant point of compliance, as specified by the director under 8 CAR § 60-523.
- (3) Class 3 applicants proposing to fill only Class 4 type wastes as defined in this part may design and operate to the standards set forth in Subpart 6 of this part.
