Applicability. New Class 3 landfills, expansions to the area permitted for waste disposal, and portions of the permitted area which have not been constructed shall not be located in wetlands unless the owner or operator can make the demonstration in 8 CAR § 60-404 to the Director of the Division of Environmental Quality.
