(a) Applicability. Owners or operators of new Class 1 landfill units, existing units, and lateral expansions located in one hundred-year floodplains must demonstrate that the unit will not:
- (1) Restrict the flow of the base flood;
- (2) Reduce the temporary water storage capacity of the floodplain; or
- (3) Result in washout of solid waste so as to pose a hazard to human health and the environment.
- (b) Effective date. The owner or operator of existing Class 1 landfills must place the demonstration in the operating record and submit the demonstration to the Director of the Division of Environmental Quality not later than the compliance date in 8 CAR § 60-104(d).
