8 CAR § 60-401 – Location restrictions — Responsibilities

(a) Applicants for a permit for a Class 1 landfill shall be responsible for selection of the proposed site subject to the provisions of this section.
(b) Solid waste disposal facilities or practices which violate any of the following criteria pose a reasonable probability of adverse effects on health or the environment.
