General application requirements

- (a) Preapplication conference. The Division of Environmental Quality may require the applicant to attend a preapplication conference to discuss application requirements and the findings of the preliminary site investigation.
(b) Submittal of preliminary geotechnical report.
- (1) Prior to completing a detailed facility design and submitting a full application for a disposal facility permit, the division may require applicants for Class 1 and Class 3 landfills to submit a preliminary geotechnical investigation report.
(2)
- (A) The report shall be in general conformance with the requirements of Subpart 11 of this part and shall identify the proposed solid waste boundary of the facility in relation to such tests and investigations that have been made at the site and additional tests and investigations that are proposed to be made at the site.
- (B) The results of the preliminary geotechnical report and preliminary site investigation shall be utilized in the facility design.
(c) Application contents for landfills.
- (1) Applications for permits for the construction or operation of new or existing solid waste disposal facilities shall be submitted to the division on forms prepared by the division.
(2) All applications for solid waste disposal facilities shall contain at least the following information, either in the application form itself or in supporting documentation provided with the application:
- (A) The name and mailing address of the applicant and the owner of the facility, and the physical address of the facility as denoted by the local 911 service;
- (B) A description of the soil characteristics of the site from a physical investigation of the site;
- (C) File marked copy of the legal instrument provided with the application giving right to use the realty for solid waste disposal or processing including a current boundary survey of the property by a registered land surveyor;
- (D) Types, quantities, classifications, and sources of waste proposed to be disposed of or processed at the site or facility;
- (E) All proposed Class 1 and Class 3 landfills shall include a written program that will be utilized to monitor wastes to detect and prevent the disposal of hazardous wastes;
- (F) Identification of the special materials identified in Subpart 6 of this part proposed for acceptance at the facility;
- (G) Predominant land use of the area in which the site or facility is located including identification of dwellings and wells within two (2) miles of the site through:
(i) Visual inspection;
(ii) Review of historical records; and
- (iii) Survey of surrounding residents;
- (H) Total waste capacity, projected utilization rate, and total life expectancy of the facility;
- (I) The proposed use of the site or facility upon termination of the disposal operation;
- (J) Procedures and site improvements for prevention of unauthorized use of the site or facility;
- (K) Application fee in accordance with the current fee schedule;
- (L) Permit plans and specifications;
- (M) Operating plan and narrative;
- (N) Design narrative, including design calculations;
- (O) Hydrogeologic report;
- (P) Ground water monitoring plan;
- (Q) Detailed cost estimates for closure of the landfill units and for post-closure care;
- (R) Such additional information deemed necessary by the division for a determination as to the issuance of the permit;
- (S) The additional and specific application requirements applicable to each class of solid waste disposal;
(T)
- (i) A 7.5-minute United States Geological Survey quadrangle map showing disposal or processing site boundaries.
- (ii) The processing facility must also be shown on an appropriate scale city or county map;
- (U) A narrative description of the access roads and streams that are in close proximity of the site or facility; and
(V)
- (i) Documentation from appropriate agencies regarding whether the selected site is in conformance with the airport safety, floodplain, and wetlands separation distances and location restrictions, and protective of:
- (a) (a) Endangered species;
(b) (b) Historic archeology; and
(c) (c) Flora and fauna.
- (ii) Those agencies include, but are not limited to, the:
- (a) (a) Federal Aviation Administration;
(b) (b) United States Army Corps of Engineers;
(c) (c) United States Fish and Wildlife Service;
- (d) (d) Arkansas State Game and Fish Commission;
- (e) (e) Arkansas Historic Preservation Program;
- (f) (f) Arkansas Natural Heritage Commission; and
(g) (g) Department of Health.
- (d) Application contents for solid waste processing facilities. Application contents for composting facilities, transfer stations, and solid waste recovery facilities shall conform to the requirements identified in the respective subparts covering those facilities.
- (e) Other rules. In addition to the information set forth herein, an applicant shall, if the type of disposal site or facility is one for which a specific rule has been promulgated, submit such additional information as is required by the specific rule.
