(a)
- (1) A permitted part 70 source may trade increases and decreases in emissions within the permitted facility, where 8 CAR pt. 41 provides for such emissions trades without requiring a permit revision.
(2) The permittee shall provide seven (7) days’ written notice to the Division of Environmental Quality which shall state:
- (A) When the proposed change will occur;
- (B) A description of such change;
- (C) Any change in emissions;
- (D) The permit requirements with which the source will comply using the emissions trading provisions of the State Implementation Plan; and
- (E) The pollutants emitted subject to the emissions trade.
- (3) The notice shall also refer to the provisions with which the source will comply in the State Implementation Plan and that provide for the emissions trade.
- (b) The permit shield described in Subpart 6 of this part shall not extend to any change made pursuant to this section.
- (c) Compliance with the permit requirements that the source will meet using the emissions trade shall be determined according to requirements of the State Implementation Plan authorizing the emissions trade.
