A permit, permit modification, or permit renewal may be issued only if all of the following conditions have been met:

1. (1) The Division of Environmental Quality has received a complete application for a permit, permit modification, or permit renewal, except that a complete application need not be received before issuance of a general permit;
2. (2) Except for modifications qualifying for minor permit modification procedures under Subpart 9 of this part, the division has complied with the requirements under Subpart 5 of this part, for public participation and for notifying and responding to affected states;
3. (3) The processing of the permit application and the conditions of the permit provide for compliance with all applicable requirements and the requirements of this part; and
4. (4) The Administrator of the Environmental Protection Agency has received a copy of the proposed permit and any notices required under Subpart 5 of this part, and has not objected to issuance of the permit within the time period specified therein.
