- (a) The Arkansas Pollution Control and Ecology Commission hereby adopts and incorporates by reference those provisions of 40 C.F.R. pts. 72 and 76 (including all provisions of pts. 73, 74, 75, 77, and 78 referenced therein) as in effect on October 15, 1999, for purposes of implementing an acid rain program that meets the requirements of Title IV of the Clean Air Act.
- (b) The term “permitting authority” shall mean the Division of Environmental Quality, and the term “administrator” shall mean the Administrator of the United States Environmental Protection Agency.
- (c) If the provisions or requirements of 40 C.F.R. pt. 72 or 76 conflict with or are not included in this part, the 40 C.F.R. pt. 72 or 76 provisions and requirements shall apply and take precedence.
