- (a) In accordance with 40 C.F.R. § 70.9, as promulgated July 21, 1992, and last modified June 3, 2010 (75 FR 31607), the owners or operators of part 70 sources shall pay initial and annual fees that are sufficient to cover the permit program costs.
- (b) The Division of Environmental Quality shall ensure that any fee required by these regulations will be used solely for permit program costs.
