(1) Sources currently holding permits issued pursuant to this part but whose emissions are below the permitting thresholds of 8 CAR § 41-301, and above the registration thresholds of 8 CAR § 40-215, may elect to continue to operate under their existing Part 41 permit or they may submit a registration under 8 CAR § 40-215 and request their Part 41 permit to be terminated.
(2) The Part 41 permit shall remain in effect until terminated.
(3) If a source takes no action, the Part 41 permit shall remain in effect.
(b) A source otherwise subject to registration under 8 CAR § 40-215 may elect to instead operate under a permit issued in accordance with 8 CAR § 41-302.
