This subpart does not apply to:

1. (1) Transfers made to storage tanks at gasoline dispensing facilities or gasoline service stations equipped with floating roofs or their equivalent;
2. (2) Stationary storage tanks with a capacity of not more than five hundred fifty gallons (550 gals.), if the tanks are equipped with a submerged fill pipe;
3. (3) Stationary storage tanks used exclusively for the fueling of implements of normal farm operations;
4. (4) Facilities selling less than ten thousand gallons (10,000 gals.) of gasoline per month;
5. (5) Independent small business marketers of gasoline selling less than fifty thousand gallons (50,000 gals.) per month; and
6. (6) Any other facility or use exempted by state or federal statute.
