(1) Any person to whom an emergency order is issued may file a written request for hearing with the commission secretary within ten (10) calendar days of the issuance of the order.
(2) Any request for hearing shall comply with the provisions of Subpart 6 of this part.
(b)
(1) An adjudicatory hearing shall be held within ten (10) calendar days of filing the written request with the commission secretary, unless otherwise agreed by the person requesting the hearing and the Director of the Division of Environmental Quality.
(2) Notice of the time, date, and place of the hearing shall be given to the person requesting the hearing by the administrative hearing officer at the earliest opportunity and by any means calculated to give actual notice to that person.
