When used in this part:

1. (1) "Commission" means the Arkansas Pollution Control and Ecology Commission;
2. (2) "Director" means the Director of the Division of Environmental Quality;
3. (3) "Division" means the Division of Environmental Quality;

4. (4) "Person" means any:

   1. (A) Individual;
   2. (B) Corporation;
   3. (C) Company;
   4. (D) Firm;
   5. (E) Partnership;
   6. (F) Association;
   7. (G) Trust;
   8. (H) Joint stock company;
   9. (I) State agency;
   10. (J) Government instrumentality or agency;
   11. (K) Institution;
   12. (L) County, city, town, or municipal authority or trust;
   13. (M) Venture; or
   14. (N) Other legal entity, however organized; and
5. (5) "Violation" means the failure to comply with any statute, regulation, order, rule, agreement, permit, or any part thereof, and includes both acts and omissions.
