(a) The process to appeal the closure of a poll under Arkansas Code § 7-5-101(d)(4) is begun by filing a document that provides the following information:

1. (1) The appellant’s name;
2. (2) The appellant’s address;
3. (3) The appellant’s telephone number or email address if available;
4. (4) A signature attesting to the truthfulness of the statements in the appeal under penalty of perjury; and

5. (5) A complete statement of the facts and circumstances that form the basis of this appeal, including:

   1. (A) The location or name of the poll or polls that have been closed;
   2. (B) Whether any poll or polls were designated to replace the poll or polls that were closed, if known;
   3. (C) The reason this closure is adverse to the election process;
   4. (D) Whether the appellant is an eligible voter in the county; and
   5. (E) Any additional information the appellant believes is relevant to the appeal.

(b)

1. (1) An appeal must arrive in the office of the State Board of Election Commissioners by the close of business on the seventh calendar day from the date on which the county board of election commissioners acted to close the poll or polls that are the subject of the appeal.
2. (2) If the seventh day falls on a weekend, a state holiday, or a day that state offices in Pulaski County are closed, the appeal shall be timely if received by the close of business on the next business day the office of the State Board of Election Commissioners is open.

(c)

1. (1) The appeal:

   1. (A) Must be in writing; and
   2. (B) May be:

(i) Filed in person;

1. (ii) Submitted by mail or common carrier; or

   1. (iii) Submitted electronically.
2. (2) If submitted electronically, the appellant must include a facsimile of the appellant’s original wet signature on the document.
