(a)
- (1) Any citizen may file a complaint with the Arkansas Ethics Commission against a person alleged to have violated one (1) or more of the laws over which the commission has jurisdiction.
- (2) The commission staff has prepared a citizen complaint form which may be furnished free of cost to any citizen.
(b)
- (1) A complaint must be filed within four (4) years after the alleged violation occurred.
- (2) If the alleged violation is the failure to file a report or the filing of an incorrect report, the complaint must be filed within four (4) years after the date the report was due.
(c) A valid complaint to the commission must:
- (1) Clearly set forth the name or names of the person or persons alleged to have violated laws under the commission’s jurisdiction;
- (2) Clearly set forth the facts the complainant believes constitute a violation of laws under the commission’s jurisdiction; and
- (3) Be signed under penalty of perjury.
(d) A citizen complaint shall be timely filed if it is:
- (1) Hand-delivered to the commission on or before the date that the complaint is due;
- (2) Mailed to the commission, properly addressed, postage prepaid, and bearing a postmark indicating that it was received by the post office or common carrier on or before the date that the complaint is due; or
- (3) Received via email or facsimile by the commission on or before the date that the complaint is due, provided the original is received by the commission within ten (10) days of the transmission.
- (e) A complaint meeting the foregoing requirements shall be accepted by the staff of the commission provided it is written on a commission complaint form or is otherwise reduced to writing.
(f)
- (1) Any commissioner who shall receive a written complaint or evidence relevant to an ongoing complaint investigation shall immediately transfer same to the director of the commission for proper handling.
- (2) If, however, the written complaint is against the director or other staff member, the commissioner shall not release same to the director, except as provided in this part.
- (g) The commission shall prepare a citizen complaint form and make it publicly available on the commission’s website.
