As used in this part:

1. (1)

   1. (A) “Multifunction school activity bus (MFSAB)” means “A school bus whose purposes do not include transporting students to and from home or school bus stops”, as defined in 49 C.F.R. § 571.3.
   2. (B) This subcategory of school bus meets FMVSS 222 for school buses, except for the color (NSBY) and traffic control requirements (alternately flashing signal and stop arm);

2. (2)

   1. (A) “School bus” means a bus owned, leased, contracted to, or operated by a school or school district and regularly used to transport students to and from school or school-related activities, but not including a charter bus or transit bus.
   2. (B) A school bus must meet all applicable FMVSS and be readily identified by alternately flashing lamps, National School Bus Yellow paint, and the legend “School Bus”, except as may be provided for the multifunction school activity bus;
3. (3) “Specially equipped” means a school bus designed, equipped, or modified to accommodate students with special needs;

4. (4) “Type A” means a school bus that is:

   1. (A) A conversion or body constructed upon a van-type compact truck or a front-section vehicle with a gross weight rating of ten thousand pounds (10,000 lbs.) or less; and
   2. (B) Designed for carrying more than ten (10) persons;
5. (5) “Type A-1” means a school bus that is a conversion or bus constructed utilizing a cutaway front-section vehicle with a left side driver’s door with a gross vehicle weight rating (GVWR) of fourteen thousand five hundred pounds (14,500 lbs.) or less;

6. (6)

   1. (A) “Type B” means a school bus that is:

      1. (i) A conversion or body constructed and installed upon a van or front-section vehicle chassis or stripped chassis with a vehicle weight rating of more than ten thousand pounds (10,000 lbs.); and
      2. (ii) Designed for carrying more than ten (10) persons.

   2. (B) Part of the engine is:

      1. (i) Beneath or behind the windshield; and
      2. (ii) Beside the driver's seat.
   3. (C) The entrance door is behind the front wheels;

7. (7)

   1. (A) “Type C” means a bus that is:

      1. (i) A body installed upon a flat back cowl chassis with a gross vehicle weight rating of more than ten thousand pounds (10,000 lbs.); and
      2. (ii) Designed for carrying more than ten (10) persons.
   2. (B) All of the engine is in front of the windshield.
   3. (C) The entrance door is behind the front wheels; and

   1. (A) “Type D” means a bus that is:

      1. (i) A body installed upon a chassis with the engine mounted in the front, midship, or rear with a gross vehicle weight rating of more than ten thousand pounds (10,000 lbs.); and
      2. (ii) Designed for carrying more than ten (10) persons.

   2. (B) The engine may be:

      1. (i) Behind the windshield and beside the driver's seat;
      2. (ii) At the rear of the bus;
      3. (iii) Behind the rear wheels; or
      4. (iv) Midship between the front and rear axles.
   3. (C) The entrance door is ahead of the front wheels.
