For the purpose of this part:
- (1) "Altering" means the process of making a significant change to a structure, which essentially creates a different structure;
- (2) "Building" means the process of making a structure by putting together materials, parts, et cetera;
- (3) "Demolishing" means the process of wrecking or razing a structure for the purpose of rendering the structure unfit for its current use;
- (4) "Facility" means a building or space, including related areas such as the physical plant and grounds, whose primary use is for students to receive instruction that is an integral part of an adequate education as described in Arkansas Code § 6-20-2302;
- (5) "Goods" means any items of tangible movable personal property other than money;
(6) "Governmental agency" means an executive, legislative, or judicial agency, department, board, commission, authority, institution, or other instrumentality of:
- (A) The federal government;
- (B) The state; or
- (C) A county or municipality;
- (7) "Improving" means the process of making an addition to real property;
(8) "Institution of higher education" means any:
- (A) Public university, college, technical college, and community college now or hereafter established or authorized by the General Assembly; or
- (B) Nonpublicly supported not-for-profit college or university.
(9) "Maintaining" or "repairing" means any activity or improvement to a facility, and, if necessary, related areas such as the physical plant and grounds, that:
- (A) Maintains, conserves, or protects the state of condition or efficiency of the facility; or
- (B) Brings the state of condition or efficiency of the facility up to the facility's original condition of completeness or efficiency;
(10) "Political subdivision" means:
- (A) Counties;
- (B) Municipalities; and
- (C) School districts;
(11) "Public-public partnership" means a project delivery method in which a school district may enter into a contract to partner with another governmental agency, political subdivision, or institution of higher education to meet a clearly defined need for:
- (A) Facilities;
- (B) Infrastructure; or
- (C) Goods and services;
- (12) "Real property" means land and anything attached to or erected on it, excluding anything that may be severed without injury to the land;
- (13) "School district" means a geographic area with an elected board of directors that qualifies as a taxing unit for purposes of ad valorem property taxes under Title 26 of the Arkansas Code and which board conducts the daily affairs of public schools under the supervisory authority vested in it by the General Assembly and Title 6 of the Arkansas Code; and
- (14) "Services" means the furnishing of labor, time, or effort by a contractor, not involving the delivery of a specific end product other than reports which are merely incidental to the required performance.
