(a)

1. (1) For students suspected of having emotional disturbance, a clinical diagnosis must be made by either a licensed psychologist or psychiatrist.
2. (2) A clinical diagnosis alone does not qualify a student to receive special education services.

(b)

1. (1) The evaluation committee shall determine the adverse effect on educational performance of the emotional disturbance and the corresponding need for special education and related services.
2. (2) Decisions related to the need for special education services are the responsibility of the evaluation committee.
