“Special day school, public” means instruction provided by a special education teacher to students with disabilities whose:

1. (1) Programs require in excess of sixty percent (60%) of the instructional day in special education services; and
2. (2) Special education services are delivered in a day school operated by a public agency or an educational service agency.
