1. (a) As used with regard to IEPs and agency responsibilities for transition services, “participating agency” means a state or other public agency, including a state vocational rehabilitation agency, other than the public agency responsible for a student’s education, that is likely to be responsible for providing or paying for transition services to the student, therefore being financially and legally responsible.
2. (b) As used in connection with education records and confidentiality of information, participating agency means any agency or institution that collects, maintains, or uses personally identifiable information, or from which information is obtained, under Part B of the Individuals with Disabilities Education Act.
