“Free appropriate public education” or “FAPE” means special education and related services that:

1. (1) Are provided at public expense, under public supervision and direction, and without charge;
2. (2) Meet the standards of the SEA, including the requirements of Part B of the Individuals with Disabilities Education Act, as amended;
3. (3) Include an appropriate preschool, elementary school, or secondary school education in Arkansas; and
4. (4) Are provided in conformity with an individualized education program that meets the requirements of 34 C.F.R. §§ 300.320 – 300.324 and 6 CAR § 130-801 et seq.
