In the case of a child who is a ward of the state, the surrogate parent alternatively may be appointed by the judge overseeing the child's case, provided that the surrogate meets the requirements in 34 C.F.R. § 300.519(d)(2)(i) and (e) and 6 CAR § 130-1504(b)(1) and 6 CAR § 130-1505.
