Test security and confidentiality

(a)
- (1) A violation of the security or confidential integrity of any test or assessment is prohibited.
(2)
- (A) Procedures for maintaining the security and confidential integrity of testing and assessment instruments and procedures shall be specified in the appropriate test or assessment administration instructions and training from the Division of Elementary and Secondary Education.
- (B) Conduct that violates the security or confidential integrity of a test or assessment is defined as any departure from either the:
(i) Requirements established by the division for the administration of the assessment; or
- (ii) Procedures specified in the applicable test administration materials or training.
- (3) A person who violates the security or confidential integrity of any test or assessment, or a public school or school district in which prohibited conduct occurs, may be sanctioned by the State Board of Education in accordance with the division’s Rules Governing Test Security, Testing Violations, and Testing Improprieties, 6 CAR pt. 65, and the division’s Rules Governing the Code of Ethics for Arkansas Educators, 6 CAR pt. 192, as appropriate.
(b)
- (1) District test coordinators, staff involved in test administration including technology support staff, test administrators, and test proctors of the state-required assessments shall abide by the requirements of the security agreement developed by the division.
(2) Public schools shall maintain signed copies of the agreement for three (3) years.
- (c)
(1) The superintendent or district test coordinator of each public school district shall develop procedures to ensure the security and confidential integrity of all:
- (A) Assessment instruments; and
- (B) Test items.
- (2) The superintendent or district test coordinator is responsible for immediately notifying the division in writing of conduct that violates the security or confidential integrity of an examination or assessment as outlined in the division’s Rules Governing Test Security, Testing Violations, and Testing Improprieties.
