- (a) All public school districts shall administer a developmentally appropriate assessment approved by the State Board of Education to all students in kindergarten, first grade, and second grade (K-2) in reading and mathematics.
(b)
- (1) Students with disabilities shall participate in the kindergarten and grades one and two (K-2) assessment unless the student’s IEP team determines that the student is unable to participate due to the student’s disability.
- (2) If the student’s IEP team determines that the student is unable to participate due to the student’s disability, the student’s IEP shall include goals and periodic reviews to ensure the student is meeting expected growth and progress.
(c)
- (1) English learners, including those with less than one (1) year in a United States school, shall participate in the kindergarten and grades one and two (K-2) assessment program.
(2)
- (A) English learners may access state-approved accommodations provided such accommodations:
(i) Have been recommended by the student’s language proficiency assessment committee (LPAC); and
(ii) Are used regularly in classroom instruction and assessment.
- (B) Only those accommodations that do not interfere with the validity of the test may be used on the assessment.
